Plaza respects intellectual-property rights and responds to complete notices concerning material hosted through Plaza.

§ 1Before sending a notice

Consider whether the material is authorized, licensed, in the public domain, or protected by fair use or another legal exception. Plaza cannot give legal advice. A person who knowingly materially misrepresents that material is infringing, or that removal was mistaken, may be liable under 17 U.S.C. § 512(f).

§ 2Copyright infringement notice

A DMCA notice must include:

  1. A physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work, or a representative list if the notice covers multiple works.
  3. Identification of the allegedly infringing material and information sufficient to locate it, including the exact URL.
  4. Your name, mailing address, telephone number, and email address.
  5. A statement of good-faith belief that the use is not authorized by the owner, its agent, or law.
  6. A statement that the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner.

Send complete notices to [email protected]. Incomplete notices may delay action.

§ 3Plaza's response

Plaza may forward a notice to the affected customer, remove or disable access to identified material, preserve evidence, and take other appropriate action. Plaza may restore material if a valid counter-notice is received and the claimant does not timely notify Plaza of a court action. Plaza may reject notices that are incomplete, abusive, fraudulent, or unrelated to copyright.

§ 4Counter-notice

If material was removed by mistake or misidentification, the affected customer may send a counter-notice containing:

  1. Your physical or electronic signature and identification of the removed material and its prior location.
  2. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled by mistake or misidentification.
  3. Your name, address, telephone number, and consent to the jurisdiction of the federal district court for your address, or if outside the United States, a federal district where Plaza may be found.
  4. A statement that you will accept service of process from the original notifier or that person's agent.

§ 5Repeat infringers and other rights

In appropriate circumstances, Plaza terminates accounts of repeat copyright infringers. We evaluate complete notices, counter-notices, court outcomes, retractions, repetition, and other reliable evidence. Plaza may also act on trademark, privacy, publicity, or other rights complaints under the Acceptable Use Policy, but the DMCA counter-notice procedure applies only to copyright.
